1. Introduction

Yield BD Pty Ltd ("Yield BD," "we," "us," or "our") is committed to protecting the privacy of individuals who interact with our business, visit our website at yieldbd.com, use our online tools, or engage our services. This Privacy Policy explains how we collect, use, store, disclose, and protect your personal information in accordance with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles ("APPs").

By accessing our website, completing any of our forms, booking a diagnostic call, participating in any of our programs, or engaging our services, you acknowledge that you have read and understood this Privacy Policy. If you do not agree with the practices described in this policy, please do not use our website or provide your personal information to us.

This policy applies to all personal information collected by Yield BD, whether collected online through yieldbd.com and associated digital properties, or offline through service delivery, events, and direct communications.

2. Information We Collect

2.1 Information You Provide Directly

We collect personal information that you voluntarily provide to us through the following channels:

Website forms and tools. When you complete the Revenue Leak Audit, submit an enquiry through our contact form, or book an AI Revenue Diagnostic call, we may collect your first name, last name, email address, mobile phone number, business name, and any additional notes or messages you include in the form submission.

Diagnostic calls and consultations. During consultations, you may provide us with information about your business operations, revenue, team structure, technology systems, and operational challenges. We collect this information to assess your business needs and recommend appropriate solutions.

Service engagements. When you engage Yield BD for any of our services - including Tier 1 AI Solutions, Tier 2 Custom AI Agents, or Tier 3 Mastermind Membership - we collect the information necessary to deliver those services, which may include business operating data, contact records, system access credentials, and financial information relevant to the engagement.

Events and programs. When you register for or attend Yield BD events, masterminds, workshops, or programs - whether delivered virtually via video conferencing platforms or physically at meeting venues - we collect registration details including your name, email, phone number, and any dietary or accessibility requirements where applicable.

Payment information. When you make a payment for our services, your payment is processed through Stripe and managed through Xero. We do not store your full credit card details or banking information on our systems. Our payment processors handle and store your payment data in accordance with PCI-DSS standards and their own privacy policies.

2.2 Information Collected Automatically

When you visit yieldbd.com, certain information is collected automatically through cookies and similar technologies:

Analytics data. We use Google Analytics to collect information about how visitors interact with our website, including pages viewed, time spent on pages, referral sources, browser type, device type, and approximate geographic location. This data is aggregated and does not personally identify individual visitors.

Tracking and conversion data. Our website uses the GoHighLevel ("GHL") External Tracking script, which tracks form submissions and visitor behaviour to help us understand how visitors engage with our site and to attribute conversions to the correct sources. The GHL calendar booking widget embedded on our booking page may also set third-party cookies.

Advertising pixels. We may use tracking pixels from Meta (Facebook), Google Ads, LinkedIn, or other advertising platforms to measure the effectiveness of our advertising, deliver relevant advertising, and build custom audiences. These tools collect data about your browsing activity across websites and may set non-essential cookies.

Additional analytics tools. We may from time to time deploy additional analytics or session-recording tools (such as Hotjar, Lucky Orange, or similar services) to understand how visitors use our website and to improve the user experience. These tools may collect data about mouse movements, clicks, scrolling behaviour, and interactions with page elements. Where such tools are deployed, they will be disclosed in this section and subject to the cookie consent requirements outlined in Section 5 of this policy.

2.3 Information We Do Not Collect

We do not knowingly collect personal information from individuals under the age of 18. Our services are designed exclusively for business owners and operators, and no part of our website, tools, or services is directed at minors.

3. How We Use Your Information

We collect and use personal information for the following purposes:

To respond to enquiries. When you contact us through a form or email, we use your information to respond to your enquiry and provide the information you requested.

To deliver our services. When you engage Yield BD, we use your information to design, build, deploy, and manage AI solutions and AI agents within your business. This includes accessing business data, system credentials, and operational information necessary to deliver the engagement.

To process payments. We use payment information to process transactions for our services, memberships, and programs through our payment processor, Stripe.

To communicate with you. We may use your email address and phone number to send you information related to your engagement, updates about our services, invitations to events, and - where you have opted in - marketing communications including newsletters, offers, and educational content.

To improve our website and services. We use analytics and tracking data to understand how visitors interact with our website, to improve user experience, and to optimise our marketing and service delivery.

To comply with legal obligations. We may use or retain your information where required by Australian law, including tax, financial reporting, and regulatory requirements.

4. Client Data During Service Delivery

When Yield BD delivers Tier 1 AI Solutions or Tier 2 Custom AI Agents, we may access and handle data that belongs to our clients, including data relating to our clients' customers, contacts, prospects, and business operations ("Client Data").

4.1 Access and Handling

The specific categories of Client Data we access vary depending on the nature of the engagement and may include CRM records, customer contact information, email lists, sales records, financial data, internal communications, and operational documents. Access is limited to what is necessary to design, build, deploy, and manage the systems agreed upon in the engagement scope.

4.2 Storage and Location

Client Data is held within a dedicated sub-account established for each client within the GoHighLevel platform, and may also reside within the client's own CRM and internal systems where integrations are deployed. Yield BD does not maintain independent copies of Client Data on separate infrastructure outside of the platforms used for service delivery.

4.3 Client Data Ownership

Client Data remains the property of the client at all times. Yield BD does not claim any ownership of, or proprietary interest in, any data belonging to our clients.

4.4 End-Customer Data

In the course of deploying AI solutions and agents (such as customer service agents, lead generation agents, or follow-up automation), the systems we build may interact with and process data from our clients' end-customers - including contact details, enquiry content, and communication records. This data is captured and maintained within the client's own systems, to which the client has full access and management control. Yield BD accesses this data only to the extent necessary to deliver, monitor, and refine the deployed systems.

4.5 No Use for Other Purposes

Client Data - including any end-customer data processed through deployed systems - is never used by Yield BD for any purpose other than delivering the agreed services. Client Data is not used to train AI models, is not aggregated with data from other clients, and is not analysed for Yield BD's own commercial benefit.

5. Cookies and Tracking Technologies

5.1 What Are Cookies

Cookies are small text files placed on your device when you visit a website. They serve various functions, including remembering your preferences, understanding how you interact with the site, and enabling advertising and analytics.

5.2 Cookies We Use

Essential cookies. These are necessary for the basic functioning of our website, such as maintaining session state and enabling form submissions. These cookies do not require your consent.

Analytics cookies. Google Analytics uses cookies to collect aggregated data about website traffic and visitor behaviour. This helps us understand how our website is used and where improvements can be made.

Functional and tracking cookies. The GoHighLevel External Tracking script and calendar booking widget set cookies to track form submissions, visitor behaviour, and booking interactions. These cookies enable us to manage our lead capture and booking processes effectively.

Advertising and remarketing cookies. Where enabled, tracking pixels from Meta, Google Ads, LinkedIn, or other advertising platforms may set cookies to measure advertising effectiveness, deliver relevant ads, and build custom audiences across platforms.

5.3 Your Cookie Choices

When you first visit yieldbd.com, you will be presented with a cookie consent notice that allows you to accept non-essential cookies or manage your preferences. You can change your cookie preferences at any time by clicking the cookie settings link in the website footer.

You can also control cookies through your browser settings. Most browsers allow you to block or delete cookies. However, blocking certain cookies may affect your ability to use some features of our website, including form submissions and booking functionality.

5.4 Third-Party Cookies

Some cookies on our website are set by third-party services, including Google Analytics, GoHighLevel, Meta, and Stripe. These third parties have their own privacy policies governing how they collect and use data. We encourage you to review their respective privacy policies:

6.2 No Sharing with Marketing Partners

We do not share your personal information with marketing partners, referral partners, advertising networks, or any other third parties for their own marketing or commercial purposes. This applies to all categories of personal information we collect, including website visitor data, prospect data, client data, and Client Data.

6.3 Service Providers and Technology Platforms

In the course of operating our business and delivering our services, your information may be processed by the following categories of third-party service providers, solely for the purpose of providing services to Yield BD:

  • Payment processing: Stripe and Xero, for processing payments and managing financial records securely.

These service providers are engaged on the basis that they process data only as necessary to provide their services and in accordance with their own privacy and security obligations. We do not authorise any service provider to use your data for their own purposes.

6.4 Legal Requirements

We may disclose personal information where required or permitted by law, including in response to a court order, subpoena, regulatory investigation, or where we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

7. Data Storage and International Transfers

7.1 Storage Location

Yield BD stores personal information and Client Data within Australia wherever practicable. Our website is hosted on Vercel, and our primary service delivery platform (GoHighLevel) maintains data in accordance with their hosting infrastructure.

7.2 International Transfers

Some of the third-party platforms we use to operate our business and deliver services - including GoHighLevel, Stripe, Anthropic, and OpenAI - may store or process data on servers located outside of Australia, including in the United States. Where personal information is transferred outside of Australia, we take reasonable steps to ensure that the overseas recipient handles your information in accordance with the Australian Privacy Principles, or is subject to a substantially similar privacy framework. By engaging Yield BD or using our website, you acknowledge and consent to these transfers where they are necessary for the provision of our services.

8. Data Retention

8.1 Prospect Data

If you complete the Revenue Leak Audit, submit a contact form, or otherwise provide your details but do not proceed to engage our services, your information will be retained on our marketing and communications lists. We conduct an annual list cleansing process, and prospects who have not engaged with our communications for a continuous period of 12 months will be removed from our active lists.

8.2 Client Data

Client Data is maintained throughout the active engagement period and for a maximum of two (2) years following the conclusion of the engagement. After this retention period, Client Data is securely deleted or de-identified unless retention is required by law.

8.3 Financial and Tax Records

Where we are required to retain records under Australian tax law or other regulatory obligations, we will retain the minimum information necessary for the required retention period, even if you request deletion of your data.

8.4 Website Analytics Data

Aggregated website analytics data is retained in accordance with the default retention settings of the analytics platforms we use (currently Google Analytics). This data does not personally identify individual visitors.

9. Your Rights

Under the Australian Privacy Act 1988, you have the following rights in relation to your personal information:

9.1 Access

You have the right to request access to the personal information we hold about you. We will respond to access requests within 30 days and provide the information in a reasonable format.

9.2 Correction

You have the right to request that we correct any personal information we hold about you that is inaccurate, out of date, incomplete, or misleading.

9.3 Deletion

You have the right to request that we delete your personal information from our systems. We will honour deletion requests except where retention is required by law (see Section 8.3). Upon receiving a valid deletion request, we will delete your personal information within 30 days and confirm the deletion to you in writing.

9.4 Opt-Out of Marketing Communications

You may opt out of receiving marketing communications from Yield BD at any time by clicking the unsubscribe link in any marketing email, or by contacting us at info@yieldbd.com. Opting out of marketing communications does not affect transactional or service-related communications relating to an active engagement.

9.5 Complaints

If you believe that Yield BD has breached the Australian Privacy Principles or mishandled your personal information, you may lodge a complaint with us at info@yieldbd.com. We will acknowledge your complaint within 7 days and provide a substantive response within 30 days. If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner ("OAIC") at www.oaic.gov.au.
